Divorce during menstrual period

Question

A husband divorced his wife with one divorce, then he was told that she was in her menstrual period at the time when he divorced her. Does the divorce count?

If a marriage is consummated then divorce should be given when the wife is in the state of purity. It is unlawful for a man to divorce his wife whom he had intercourse with, while she is in her menstruation, but if he does so the divorce will take place.

With regard to the question, the divorce is effected. However, if their marriage is consummated then he should revoke the divorce if her waiting period (idda) has not come to an end. Then she becomes pure and menstruates again and becomes pure again. After that if he wants he may divorce her again or if he wants he may keep her.

This is the opinion of the majority of the scholars, including the four imamas, Imam Abu Hanifah, Imam Malik, Imam Shafi’i and Imam Ahmad. (May Allah have mercy on them)

If he does not revoke the divorce then she should observe a waiting period of three menstrual periods besides that menstrual period in which she was divorced. That menstrual period in which she was divorced does not count in her waiting period (idda).

Abdullah bin Umar (may Allah have mercy on him) narrated that he had divorced his wife while she was menstruating during the lifetime of Allah’s Messenger (ﷺ) . Umar bin Al-Khattab (may Allah have mercy on him) asked Allah’s Messenger (ﷺ) about that. Allah’s Messenger (ﷺ) said, “Order him (your son) to take her back and keep her till she is clean and then to wait till she gets her next period and becomes clean again, then if he wishes to keep her, he can do so, and if he wishes to divorce her he can divorce her before having sexual intercourse with her; and that is the prescribed period which Allah has fixed for the women to be divorced.” (Bukhari-5251)

Anas bin Sirin narrated: Ibn ‘Umar said: I divorced my wife while she was menstruating. ‘Umar (may Allah be pleased with him) mentioned that to the Prophet (ﷺ) The Prophet (ﷺ) said, (to my father), “Let your son take her back.” I (Anas bin Sirin) asked (Ibn ‘Umar), “Is such a divorce counted?” Ibn ‘Umar said, “Of course” Bukhari-5252

Ibn Umar (may Allah have mercy on him) narrated: (The divorcing of my wife during her menses) was counted as one legal divorce. Bukhari- 5253

عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ مُرْهُ فَلْيُرَاجِعْهَا، ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ، ثُمَّ تَطْهُرَ، ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ” ‏.‏ رواه البخاري – ٥٢٥١

عَنْ أَنَسِ بْنِ سِيرِينَ، قَالَ سَمِعْتُ ابْنَ عُمَرَ، قَالَ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهْىَ حَائِضٌ، فَذَكَرَ عُمَرُ لِلنَّبِيِّ صلى الله عليه وسلم فَقَالَ ‏”‏ لِيُرَاجِعْهَا ‏”‏‏.‏ قُلْتُ تُحْتَسَبُ قَالَ ‏”‏ فَمَهْ ‏”‏‏ رواه البخاري – ٥٢٥٢

عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عُمَرَ، قَالَ حُسِبَتْ عَلَىَّ بِتَطْلِيقَةٍ‏.‏ رواه البخاري٥٢٥٣

اتَّفَقَ جُمْهُورُ الْفُقَهَاءِ عَلَى وُقُوعِ الطَّلاَقِ الْبِدْعِيِّ، مَعَ اتِّفَاقِهِمْ عَلَى وُقُوعِ الإِْثْمِ فِيهِ عَلَى الْمُطَلِّقِ لِمُخَالَفَتِهِ السُّنَّةَ الْمُتَقَدِّمَةَ. فَإِذَا طَلَّقَ زَوْجَتَهُ فِي الْحَيْضِ وَجَبَ عَلَيْهِ مُرَاجَعَتُهَا، رَفْعًا لِلإِْثْمِ لَدَى الْحَنَفِيَّةِ فِي الأَْصَحِّ عِنْدَهُمْ۔

وَ ذَهَبَ الشَّافِعِيُّ إِلَى أَنَّ مُرَاجَعَةَ مَنْ طَلَّقَهَا بِدْعِيًّا سُنَّةٌ، وَعَبَّرَ الْحَنَابِلَةُ عَنْ ذَلِك بِالاِسْتِحْبَابِ۔

وَ ذَهَبَ الْمَالِكِيَّةُ إِلَى تَقْسِيمِ الْبِدْعِيِّ إِلَى: حَرَامٍ وَمَكْرُوهٍ، فَالْحَرَامُ: مَا وَقَعَ فِي الْحَيْضِ أَوِ النِّفَاسِ مِنَ الطَّلاَقِ مُطْلَقًا، وَالْمَكْرُوهُ: مَا وَقَعَ فِي غَيْرِ الْحَيْضِ وَالنِّفَاسِ، كَمَا لَوْ أَوْقَعَهُ فِي طُهْرِهَا الَّذِي جَامَعَهَا فِيهِ، وَعَلَى هَذَا يُجْبَرُ الْمُطَلِّقُ فِي الْحَيْضِ وَالنِّفَاسِ عَلَى الرَّجْعَةِ رَفْعًا لِلْحُرْمَةِ، وَلاَ يُجْبَرُ غَيْرُهُ عَلَى الرَّجْعَةِ وَإِنْ كَانَ بِدْعِيًّا۔

وَ هَذَا كُلُّهُ مَا دَامَتِ الرَّجْعَةُ مُمْكِنَةً، بِأَنْ كَانَ الطَّلاَقُ رَجْعِيًّا، فَإِذَا كَانَ بَائِنًا بَيْنُونَةً صُغْرَى أَوْ كُبْرَى تَعَذَّرَ الرُّجُوعُ وَاسْتَقَرَّ الإِْثْم۔

و ذَهَبَ الْحَنَفِيَّةُ، وَهُوَ الْمَذْهَبُ عِنْدَ الْحَنَابِلَةِ، إِلَى أَنَّ الْعِدَّةَ لاَ تَنْقَضِي مَا لَمْ تَحِضِ الْمَرْأَةُ ثَلاَثَ حِيَضٍ كَوَامِل تَالِيَةٍ لِلطَّلاَقِ، فَلَوْ طَلَّقَهَا فِي طُهْرٍ فَلاَ يُحْتَسَبُ ذَلِكَ الطُّهْرُ مِنَ الْعِدَّةِ عِنْدَهُمْ، أَوْ طَلَّقَهَا فِي حَيْضِهَا فَإِنَّهَا لاَ تُحْسَبُ مِنْ عِدَّتِهَا بِغَيْرِ خِلاَفٍ بَيْنَ أَهْل الْعِلْمِ، لِحُرْمَةِ الطَّلاَقِ فِي الْحَيْضِ لِمَا فِيهِ مِنْ تَطْوِيل الْعِدَّةِ عَلَيْهَا، وَلأَِنَّ اللَّهَ تَعَالَى أَمَرَ بِثَلاَثَةِ قُرُوءٍ كَامِلَةٍ، فَلاَ تَعْتَدُّ بِالْحَيْضَةِ الَّتِي طَلَّقَ فِيهَا۔

وَالْبِدْعَةُ أَنْ يُطَلِّقَهَا ثَلَاثًا أَوْ ثِنْتَيْنِ بِكَلِمَةٍ وَاحِدَةٍ أَوْ فِي طُهْرٍ لَا رَجْعَةَ فِيهِ، أَوْ يُطَلِّقَهَا وَهِيَ حَائِضٌ فَيَقَعُ وَيَكُونُ عَاصِيًا، وَطَلَاقُ غَيْرِ الْمَدْخُولِ بِهَا حَالَةَ الْحَيْضِ لَيْسَ بِبِدْعِيٍّ، وَإِذَا طَلَّقَ امْرَأَتَهُ حَالَةَ الْحَيْضِ فَعَلَيْهِ أَنْ يُرَاجِعَهَا، فَإِذَا طَهُرَتْ فَإِنْ شَاءَ طَلَّقَهَا وَإِنْ شَاءَ أَمْسَكَهَا۔

وَقَوْلُ الْكُلِّ كَمَا فِي فَتْحِ الْقَدِيرِ إنَّهُ إذَا رَاجَعَهَا فِي الْحَيْضِ أَمْسَكَ عَنْ طَلَاقِهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ فَيُطَلِّقُهَا ثَانِيَةً. وَلَا يُطَلِّقُهَا فِي الطُّهْرِ الَّذِي يُطَلِّقُهَا فِي حَيْضِهِ لِأَنَّهُ بِدْعِيٌّ، كَذَا فِي الْبَحْرِ۔
