Question
A woman has had a baby three weeks ago and her husband has just given her two talaqs out of anger (said “i divorce you 2 times in one go). What is the ruling in this regard?
Answer
بسم الله الرحمن الرحيم
If the husband said to his wife: ‘I divorce you, two times” even out of anger then two revocable divorces will come into effect, because the divorce of an angry person is effected. The husband may take his wife back as long as he does so within the waiting period (idda) of the woman. If the waiting period is over, they may still get back together but they will need to do the marriage again.
Abu Hurairah (may Allah be pleased with him) narrated that: The Messenger of Allah ﷺ said: “There are three things which, whether undertaken seriously or in jest, are treated as serious: Marriage, divorce and taking back a wife (after a revocable divorce).” (Abu Dawud:2194, Tirmidhi:1184)
