Ruling on living abroad alone for a Muslim woman


Is it permissible for a woman to travel abroad for a long period of time without a Mahram? For example, work purposes for a year or two?


بسم الله الرحمن الرحيم 

There are two rulings here; one of travelling and the other of living alone abroad temporarily. 

As far as the travelling is concerned, it will be impermissible for a Muslim woman to travel the distance of 48miles/77km or more without her husband or a Mahram (unmarriageable kin) accompanying her.

In regards to living abroad alone, if it is a non-Muslim country then it will not be permissible for a Muslim woman to live there alone temporarily whether for work or study. 

However, if it is a Muslim majority country then it would be permissible provided the place is safe and secure. Therefore if needed, she can travel whilst accompanied by a Mahram. The Mahram may leave her and return. Also on her return she should travel back with a Mahram.

 عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ “‏ لاَ تُسَافِرِ الْمَرْأَةُ ثَلاَثَةَ أَيَّامٍ إِلاَّ مَعَ ذِي مَحْرَمٍ ‏”‏‏.‏ رواه البخاري ١٠٨٦

وقال الشيخ مفتي محمد تقي العثماني في بحوث في قضايا فقهية معاصرة: أن النسوة المسلمات لا ينبغي لهن السفر إلى بلاد غير المسلمين للدراسة أو الاكتساب، وأما إذا كانت المرأة قد توطنت إحدى هذه البلاد مع محارمها، ثم بقيت مفردة لموتِ محارمها، أو انتقالهم من ذلك المكان لسبب ما، فإنه لا مانع لها من الإقامة بمفردها، ما دامت ملتزمة بأحكام الشرع في الحجاب۔

وقال الإمام ابن قدامة في المغني: ويخرج مع المرأة محرمها حتى يسكنها في موضع، ثم إن شاء رجع إذا أمن عليها، وإن شاء أقام معها۔

Beside his teachers at Darul Uloom Bury he has also received ijazah (permission) of Hadith from the following Shuyukh: Shaykhul Hadith Shah Ahmad Shafi R.A (1920-2020), student of Shaykhul Islam Husain Ahmad Madani (r.a), and former Shaykhul Hadith and Rector of Al-Jamiatul Ahlia Darul Ulum Moinul Islam Hathazari, Bangladesh. Shaykh Mufti Muhammad Rafi Usmani The Grand Mufti of Pakistan and President of Darul Uloom Karachi. Shaykhul Hadith Mukhlisur Rahman Qiampuri Shaykhul Hadith of Jamia Islamia Umarpur, Sylhet, Bangladesh. Respected Shaykh authorized Mufti Syed Hussain with a high sanad (chain of narrators) which is as follows: Shaykh Mukhlisur Rahman Qiampuri from Shaykh Abbas Ali khanpuri (r.a) from Shaykh Abdur Rahman Amruhi (r.a) from Shaykh Fadhlur Rahman Ganj Muradabadi (r.a) from Shaykh Shah Abdul Aziz Dehlvi (r.a) from Musnadul Hind Shaykh Shah Wali Ullah Dehlvi (r.a) (Allah’s mercy be upon them all). After many years of dedication in studying Shaykh Syed Hussain went on to teaching. In order to utilise the knowledge in an easier and more modern method Shaykh decided set up an online foundation by the name of An-Nidaa Academy. As an acting director Shaykh intends to broadcast his valuable knowledge and experience to the students of deen. May Allah accept his effort to provide deeni knowledge to the masses, the effort of his Shuyukh and teachers, the effort of the staff and the effort of the student who has set down on the path to acquire knowledge of deen.
