Question

Can I give zakat to a poor Muslim woman, whose husband is rich, but does not provide her with any more than what is necessary?

Answer

بِسْمِ اللهِ الرَّحْمٰنِ الرَّحِيْم

If a Muslim woman whose husband is rich but does not give her beyond her necessities (food, clothes etc) and she does not have any means of wealth, such as cash, gold, silver or property equivalent to the zakatable amount, then you can give her zakat, and it is valid for her to receive it.

قَالَ الكَاسَانِي في البدائع: وَلَوْ دُفِعَ إلَى امْرَأَةٍ فَقِيرَةٍ وَزَوْجُهَا غَنِيٌّ جَازَ فِي قَوْلِ أَبِي حَنِيفَةَ وَمُحَمَّدٍ وَهُوَ إحْدَى الرِّوَايَتَيْنِ عَنْ أَبِي يُوسُفَ
وَجْهُ ظَاهِرِ الرِّوَايَةِ أَنَّ الْمَرْأَةَ الْفَقِيرَةَ لَا تُعَدُّ غَنِيَّةً بِغِنَى زَوْجِهَا؛ لِأَنَّهَا لَا تَسْتَحِقُّ عَلَى زَوْجِهَا إلَّا مِقْدَارَ النَّفَقَةِ فَلَا تُعَدُّ بِذَلِكَ الْقَدْرِ غَنِيَّةً
وَ فِي الفَتاوَى الهِنديَة: وَيَدْفَعُ إلَى امْرَأَةِ غَنِيٍّ إذَا كَانَتْ فَقِيرَةً، وَكَذَا إلَى الْبِنْتِ الْكَبِيرَةِ إذَا كَانَ أَبُوهَا غَنِيًّا؛ لِأَنَّ قَدْرَ النَّفَقَةِ لَا يُغْنِيهَا وَبِغِنَى الْأَبِ وَالزَّوْجِ لَا تُعَدُّ غَنِيَّةً كَذَا فِي الْكَافِي
